General Terms and Conditions

1. Scope

The following terms and conditions apply to all orders placed through our online shop by consumers and businesses.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A business is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its trade, business or profession.

With regard to businesses, these terms also apply to future business relationships without our having to refer to them again. If a business uses conflicting or supplementary general terms and conditions, we hereby object to their application; they only become part of the contract if we have expressly agreed to them.

2. Contracting party, conclusion of contract

The purchase contract is concluded with JMS advanced MedienDesign, owner Jörg Michael Schmidt.

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You may first place our products in the shopping basket without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose in the ordering process. The contract is concluded when you accept the offer for the goods contained in the basket by clicking the order button. Immediately after submitting your order you will receive a confirmation by email.

A binding contract may also be concluded earlier as follows:

  • If you have chosen PayPal as the payment method, the contract is concluded at the time you confirm the payment instruction to PayPal.
  • If you have chosen Amazon Pay, the contract is concluded at the time you confirm the payment instruction to Amazon Pay.

The languages available for the conclusion of the contract are German and English.

We store the text of the contract and send you the order data and our terms and conditions by email. You can also view the terms and conditions at any time on this page. For security reasons your past orders are no longer accessible via the internet.

3. Delivery

Shipping costs are added to the stated product prices. Details of the shipping costs are given with the offers and shown in the shopping basket. Deliveries to countries outside the European Union may be subject to import duties, taxes and customs fees of the destination country; these are levied by the authorities of that country and are payable by you. They are not included in our prices and we have no influence on them.

You may in principle collect the goods from JMS advanced MedienDesign, Holzwiese 14, 78126 Königsfeld, Germany, during the following business hours: Monday to Friday from 8:00 to 17:00, except public holidays. Please inform us at least two working days before collection so that we can prepare the goods from our warehouse. Cash payment only for collection.

4. Payment

The following payment methods are available in our shop:

Prepayment (bank transfer): If you choose prepayment, we will give you our bank details in the order confirmation and deliver the goods after receipt of payment.

PayPal: You pay the invoice amount via the online provider PayPal. You must be registered there or register first, identify yourself with your access data and confirm the payment instruction to us. Further information is given during the ordering process.

Credit card (Visa, Mastercard, American Express): Your card is charged when the order is completed. The payment is processed in encrypted form by our payment service provider PayPal (PayPal Checkout, 3-D Secure); a PayPal account is not required.

Amazon Pay: With Amazon Pay you use the payment and shipping information stored in your Amazon account. You need only your Amazon login details; you must be registered there or register first, identify yourself with your access data and confirm the payment instruction to us.

Cash on collection: You may pay in cash when collecting the goods.

5. Retention of title

The goods remain our property until paid for in full.

For businesses the following applies in addition: We retain title to the goods until all claims arising from an ongoing business relationship have been settled in full. You may resell the reserved goods in the ordinary course of business; you assign to us in advance all claims arising from such resale – irrespective of any combination or mixing of the reserved goods with a new item – in the amount of the invoice total, and we accept this assignment. You remain authorised to collect the claims; however, we may also collect the claims ourselves if you fail to meet your payment obligations.

6. Transport damage

If goods are delivered with obvious transport damage, please report such defects to the carrier as soon as possible and contact us without delay. Failure to make a complaint or to contact us has no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or the transport insurance.

7. Warranty and guarantees

The statutory law on liability for defects applies. Information on any additional guarantees and their precise conditions can be found with the product and on special information pages in the shop.

8. Consumer dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 of the German Consumer Dispute Resolution Act, VSBG).

9. Final provisions

If you are a business, German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the law of the Federal Republic of Germany applies; mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.

If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our registered office.
